End User License Agreement (EULA)
FOR THE DMAC FOUNDATION’S GETHOMESAFE MOBILE APPLICATION

This End User License Agreement (“Agreement”) is a binding contract between you (“User,” “you,” or “your”) and DMAC Foundation, a 501(c)(3) nonprofit organization (“Foundation,” “we,” “us,” or “our”), governing your use of the GetHomeSafe mobile application, including all related services, features, and content (collectively, the “App”).
By downloading, installing, accessing, or using the App, you agree to be bound by this Agreement. If you do not agree, do not use the App.
1. License Grant
The GetHomeSafe App is provided free of charge by the Foundation.
Subject to your compliance with this Agreement, the Foundation grants you a limited, non-exclusive, non-transferable, revocable license to:
Download and install the App on a personal device you own or control; and
Access and use the App solely for its intended purpose of promoting personal safety and enabling emergency support features.
You may delete the App from your device at any time.
2. Eligibility
You must be a college student with a valid .edu email address to use the app.
3. Safety Disclaimer
The GetHomeSafe App is designed to support personal safety efforts, but:
It cannot guarantee protection against harm, danger, or emergencies.
It is not a replacement for law enforcement, medical services, or emergency responders.
The Foundation is not responsible for delays, failures, or inaccuracies caused by device limitations, connectivity issues, or user error.
Users should always call 911 or local emergency services in urgent situations.
4. User Responsibilities
You agree to:
Provide accurate information when using the App.
Use the App only for lawful and appropriate purposes.
Refrain from tampering with, modifying, reverse-engineering, or interfering with the App’s functionality.
Avoid using the App in ways that may distract you from real-world safety.
5. Privacy & Data Collection
By using the App, you acknowledge that the Foundation may collect, store, and process certain data, including:
Contact information you provide;
Location data (if you enable location services);
App usage patterns to improve safety features;
Communication logs between you and designated emergency contacts.

We will never sell user data.
6. Emergency Contact Features
The App may allow you to:
Notify trusted contacts when you feel unsafe;
Share your location during a safety alert;
Trigger in-app features designed to help reduce risk.
However:
Delivery of alerts is not guaranteed.
Emergency contacts are not monitored by the Foundation.
Users are responsible for selecting appropriate emergency contacts and ensuring their contact information is correct.
7. Intellectual Property
All content, trademarks, logos, features, and technology contained in the App are the exclusive property of the DMAC Foundation or its licensors. You obtain no ownership rights by using the App.
8. Prohibited Conduct
You agree not to:
Use the App for harassment, stalking, or malicious behavior;
Misuse emergency features (including false alerts);
Upload harmful or unlawful content;
Attempt unauthorized access to servers or systems.
Any violation may result in termination of access.
9. Updates and Modifications
We may update, modify, or discontinue parts of the App at any time. Updates may be required for continued use. This Agreement applies to all modified or updated versions unless explicitly replaced.
10. Third-Party Services
The App may integrate with third-party software, mapping tools, messaging systems, or mobile operating systems.
The Foundation is not responsible for third-party failures or privacy practices.
11. No Warranties
The App is provided “as is” and “as available”, without warranties of any kind, whether express or implied.
We do not guarantee:
Continuous access to the App,
Error-free performance,
Accuracy of location or alert services.
Your use is at your own risk.
12. Limitation of Liability
To the fullest extent permitted by law, the Foundation shall not be liable for:
Indirect, incidental, punitive, or consequential damages;
Loss of data, device damage, or malfunction;
Personal injury or harm arising from reliance on the App.
Our total liability to you will not exceed $50, or the amount you paid for the App (if any), noting that the App is provided free of charge.
13. Indemnification
You agree to indemnify and hold harmless the Foundation and its officers, employees, volunteers, and partners from any claims arising from:
Your misuse of the App;
Violation of this Agreement;
Misuse of emergency contact features.
14. Termination
We may suspend or terminate your access to the App at any time for any reason, including violation of this Agreement.
You may also terminate this Agreement at any time by deleting the App from your device.
15. Governing Law
This Agreement is governed by the laws of the State of Washington.
16. Severability
If any part of this Agreement is found invalid, the remaining provisions will remain enforceable.
17. Entire Agreement
This Agreement constitutes the entire understanding between you and the Foundation regarding use of the App and supersedes all prior agreements or representations.
